This is a class action (the Class Action) against the Department of Defence (Defence) in connection with land contamination arising from Defence’s use of aqueous film forming foam at the Williamtown RAAF Base in NSW (the Contamination). It will be alleged that Defence allowed the Contamination to escape from its land causing damage to property owners and businesses for which Defence should be liable to pay compensation.
Dentons have filed the claim on a 'closed class basis'. This means that the class action is brought only on behalf of eligible property and business owners who entered into a litigation funding agreement with IMF prior to 30 September 2018.
Current stage of case
On 2 November 2016, proceedings were filed in the Federal Court in Sydney. A trial date has been set for 12 August 2019.
